Have to assume insurance covered the medical bills, the same insurance company would then take every penny of the $75k.

Also note that the lawsuit was filed in the city of Marshall, Harrison county, Texas, not where the motorcycle was purchased or where the accident happened, because Marshall has a reputation as being anti company, when it comes to these kinds of lawsuits. I wish I had been called for this jury.

This lawsuit is why motorcycles are bloated, complicated and expensive. Not to mention why I pay more for motorcycle insurance despite having never used it in 47 years.
The unskilled always fug it up for everybody else.
If you ride a motorcycle and don't know how many feet per second you're traveling at 35mph and can't execute emergency braking/swerving, you shouldn't be on the road. ABS or not.

Typical tort case. Lawyers will try to find a defendant with deep pockets. They know if they can drag the case on long enough that the company defending their product will settle.
In this case the $75k is merely the damage part of the suit. The real gravy is the penalty phase that a jury may recommend. Here, where the medical bills are reaching 1 million the lawyers are betting,. should this case go to a jury, that they could be awarded multi-million dollars. This would motivate the defendant to offer upwards of a million to make this go away.
Slimy business the law is. Ambulance chasers far outnumber the true advocates in the business. I place the blame directly on the Bar when they allowed attorneys to begin advertising in the late 60's.
