Default Brake pulsing/flashing module;legal/illegal

I am considering installing the Kuryakyn pulsating/flashing brake light module. I live in New York State and was wondering if anyone if they are legal or illegal here. I will be keeping the stock rear brake light.

A friend of mine who lives in Rochester has had a BAL on his RK for years and never had a problem.

In the Kentucky Motorcycle manual they encourage flashing the brake light.

I've had the BAL-1 installed for just over a year - set to flash about 5 times then steady on.

BRAKE LIGHT
Your motorcycle’s brake light is usually not as noticeable as the brake
lights on a car — particularly when your taillight is on. (It goes on with
the headlight.) If the situation will permit, help others notice you by
flashing your brake light before you slow down. It is especially important
to flash your brake light before:
• You slow more quickly
than others might expect (turning off a high
speed highway).
• You slow where
others may not expect it (in the middle of a block or at
an alley).
If you are being followed closely, it’s a good idea to flash your brake light
before you slow. The tailgater may be watching you and not see something
ahead that will make you slow down. This will hopefully discourage them
from tailgating and warn them of hazards ahead they may not see.

I'd look into the laws of your state to see how the look at flashing lights. I'm sure each state varies.

Yep. Most motorcycle courses encourage you to pump your brakes at a stop to bring more attention to yourself.
Pretty sure not illegal anywhere in the U.S. If it was they would have to have a disclaimer on ALL of them.

Modulating (flashing) headlights are legal in all states as the Feds allow them by law.

Even if it was illegal, go for it! My BAL-1 has been so effective over the last 3 years that I'd gladly pay a fine vs. removing it. I have it set to flash 3x's then constant on. When I apply the brakes traffic behind me quickly STOPS, and that's what counts.

there are some caveats on that though. some of the more 'radical' flashing patterns, while certainly noticeable, are outside of the code. i don't have it handy, and don't remember where i got it, but it might be enough for the op to know that yes, they are legal. and, no they aren't. clear as mud now eh?

personally, i have the magic brake light flasher from custom dynamics. i have mine set to flash fast 5 times and then go steady. i figure they don't need to be going all bat-**** crazy when i'm stopped. if i need them to flash again, i just release and squeeze the brake again.
