Default DOT Proposes Ban on Novelty Helmets

Sorry if this has already been covered. I couldn't find it.


Last Thursday (Federal Register, Vol 80, #98, p29458, 5/21/15) the DOT via the National Highway Traffic Safety Admin, proposed new rules that would, in effect, ban the sale/distribution of novelty helmets unless they could fully meet Federal Motor Vehicle Safety Standard # 218. They had to stretch their authority to propose the rule to include authority under the Moving Ahead For Progress in the 21st Century Act from 2012, that covers a bunch of other unrelated DOT crap. To me, it seems pretty underhanded. But like all govt agencies, the DOT believes they exist to care for all us pitiful ignorami - whether we like it or understand it, or not.


I tried to attach the advanced notice of proposed regulation from the Federal Register, but it's too large to attach (29 p).

Ummm! If they don't pass standards they SHOULDN'T get the DOT certification. Shouldn't need any specific ruling for that.

I read an article that the new NHTSA director is much more aggressive than previous directors. He is bringing swift legal action vehicle manufactures that drag their feet on recalls. It sounds like he is also going after our helmets now.

It would be easier for insurance companies to put a clause in the policy stating that they have the right to deny a claim to anybody not wearing a DOT approved helmet while riding a motorcycle.

That would still give people the freedom of choice as far as helmets are concerned.

I wear a DOT approved helmet when I ride but if the insurance companies pulled that stunt, I would just drop my motorcycle insurance altogether and take my chances....

It's easy enough to dummy up a proof of insurance card on a computer anyway.

Let us all know how the fake insurance card works out for you when you have gotten in an accident or had the motorcycle stolen.

Never had a bike stolen (nor will I ever), Never had an accident that required the Gestapo to come out and stick their noses into it.
If the insurance isn't gonna pay if I don't happen to be wearing a helmet, there's no reason for me to pay them for their non-coverage.

Under the circumstances that you propose....I'll take my chances.
