Yes, stuff happens. Take it off and leave it at the dealer so they can't ignore it.
That said, this is the funniest line I've seen here in a long time,

I pull the pak out of the box as my girlfriend is holding the box so it will come out. It is on the bed and I am taking the foam off and she yells "oh no!

As soon as you saw it was damaged, it should have gone back in the box. It was stupid to install it because you just gave them a way to get out of it.
That doesn't matter at this point.
Best bet is bring it then and do without it. Worse case, simply get a refund then afterwards buy it online like you were going to in the first place.
The location of the dealer in relation to your house and traffic is irrelevant.

When the tour pack first arrived at the Dealership, you didn't notice any damage to the shipping box that it arrived in? Like a crushed corner or the like. The first thing that I do when receiving a shipped parcel is a quick inspection of the carton before the shipping agent has left the premises.

When I am continually LIED to and told that someone with authority is going to be there, I would say the distance I needed to travel is very relevant.

Once? Things happen.
Twice? End of ballgame.
Put the whole business back in the box. Return it to them for a full refund.

If you really think about this the as soon as he discovered the damage is when it should have gone back in the box & returned to the dealer for a refund or replacement. The dealer would have taken care of it & maybe let him use it until the replacement arrived. Maybe not. But by taking the pack & mounting it BEFORE informing the dealer was where it all went wrong. I would never install a damaged item & then try to return it saying it was damaged before I installed it..also, I wouldn't have left the dealer without fully opening the box & inspect the whole thing, not just a peek inside.
