I posted about 3 weeks ago about my wreck on an 03 VTX 1800 (I know Its a Rice Burner.....I'm a Harley Guy NOW).
Insurance company (after 3 weeks) is still arguing and saying the bike is NOT totalled.
Blue book value on Bike = $7420.00
Extra Coverage for custom parts = $5000
Total insured Value = $12420
Honda dealer quote to fix = $12178
Service manager at Honda dealership sais acyual repair cost may be even higher since the bike may have transmission problems that cannot be assessed at this time since the bike cannot be ridden. Service Manager advises against repairing the bike, and said that they have even considered repairing a bike that was damaged that badly (Frame, engine, swing arm, entire front end etc. must all be replaced).
Can anybody explain why the insurance company is so persistant in not Totaling the bike? It seems like it would cost the company more money to fix than to total it (after selling off the damaged bike).
This is driving me nuts and I need the money to get my new HD!
I have never had that kind of problem with an accident. I have had a bike totalled from a broken footpeg mount and scrapes all over the plastics, the exhaust and other parts on one side. I took the amount for the totalled bike(more than I paid for the bike) and bopught the bike back from insurance for a few hundred. Fixed the bike, and eventually sold it.
Something isn't right here. I'm a retired insurance claims manager and your bike is an obvious total loss based on what you're saying. Your insurance company should be "insisting" it's a total and not repairable.
Ask to speak to the insurance companies claims manager and ask him to explain to you why the bike isn't being totaled. If he doesn't give you the answer you want tell him you will contact the insurance commissioner for assistance.
Ever insurance company works under the supervision of your states insurance commissioner. Their service is free and is paid for by your taxes. They were established to be certain that all insurance companies in their jurisdiction handled their insurance in a fair and honest manner. This is not fair.
Look in your phone book. I don't know what it is called in your state but it will show up under state government. You might have to make one or two calls to get into the right nitch but once you get the insurance commissioner explain to them what is going on with your company. The commissioners office will write to your company and ask them to explain their reasoning. Believe me when I tell you that the last thing an insurance company wants is to receive an insurance commission complaint. I forget now but they have something like only 3 or 4 days to answer the commissioner and explain their posture. If an insurance company is pushing the edge of the envelope too much, usually just the threat of contacting the insurance commissioner is enough to change the outcome.

Thanks... Exactly what I was looking for. I have attempted to contact the claims mgr several times, but he hasn't called me back in a few days.
I will bring the "commissioner" into it if I don't get it resolved tomorrow. I had never heard of such a thing and thank you for letting me know about it.
On a side note.... I think this may be a personal issue between me and the calims adjuster. When he first came out, he pointed out that the frame damage was minor and could be repaired. I told him that if was willing to ride a bike with a "repaired" frame.... he is an idiot. I told him that the bike was obviously totalled and that I would accept no other outcome..... and he argued it, and said that it was all repairable.
He then took a week off and failed to send to send my claim or the information to another agent, so I kept leaving him messages for a week not knowing he was on vacation. When he got back (10 days after the wreck), he finally sent it to a dealership for a repair estimate. Now that the estimate has been done by the dealer.... he is arguing the dealers estimate and saying some of the items listed (by the dealer) to be replaced should be repaired and not replaced.
Can't you take the repair money and just not fix the bike, then sell the wrecked bike for a couple hundred or something and call it a day or am I missing something?
