Tom here. Sounds like a warranty issue to me. Take it to the dealer. Even if your warranty is up you can sometimes get them to take care of such issues.

I would probably check the oil level in the tank... sounds like to me that its too full... You may have done it to specs... but Sportsters like a little less oil than recommended... I do three quarts....

It could be the seal on the dip stick... but my hunch is too much oil...

Got over 30k on an '05 Sportster and been running three quarts since I encountered the same problem when I used the recommended amount when it was new... after I adjusted the amount... never had the overflow problem again...

My wife has an '06 883. Overfilling the tank will cause it to blow out the cap when you run her hard. Prior to that, I found a leak on the plastic oil tank along a seam. It was dripping on the left cover and finding it's way to top of the rear brake fluid reservoir. Tank replaced under warranty.

Take the side covers off and make sure the tank isn't leaking. If not, I'm guessing tank is overfilled.

when you are checking the oil level, make sure you are checking it hot. I made the mistake of checking when it was cold and over filled. I think you may have done the same.

The older (late 99 model) models oil tank drain tube fits on a plug under the frame and is clamped off so that it won't leak. That could be the cleak under the bike. Did some just do an oil change?
