This is a condition referred to as blow-by. I was able to have this problem solved with replacement of the butterfly gasket on the intake.

Thanks everone for all the info. I will look into the butterfly gasket as I would like to solve the problem once and for all.

What kind of oil filter did they use?

Hopefully (and especially with the EVO engines) they didn't use a newer 5 micron filter, or even a 10 micron filter for that matter.

The two filters shown below, either short or long depending on your specific application, is what they should be using....

And also, like others have mentioned, make sure the hot oil level is below the full mark. The cold oil level should even be lower, usually about halfway between the 'half fill and fill mark'.

It looks like they used the 30 micron oil filter. I went for a 20 mile ride tonight and no oil blew out. That was a good sign.

Did you change the butterfly gasket ?

yea they put 3.5 qts in so they can charge for the 4th qt. even if it don't need it.
did they give U the other 1/2 qt? to top it off later.

Jst one more reason to do it yourself !

Same problem on my 91 Sporty1200 Shorty carb and S&S ail cleaner, tried piece of
heavy towel on lower part of cleaner, did not work, had to constantly clean air Clnr
or could not count on bike running as it should. and periodic pulling plugs showed engine running a bit rich due to oil soaked air cleaner.
So I got two hoses with one end formed at 90 degrees from H-D, fit over breather fittings and other end into old medicine bottle, drilled a number of holes
into bottle only half way around the upper half of bottle and oil collected into bottom
yet the crankcase is still vented into the atmosphere, cleaned r side of engine, went
a hundred and came back, a bit of oil in bottle and engine still **** 'n span clean

Hey Foot, you could go with a External Breather and this would eliminate the chances of blow-by. Also, below is a link on Oil drips, blow-by and What is really the correct oil level. Hope this helps you out
