I have wondered this myself but can't find anyone to give me a 100% answer. I even asked a friend of mine that is a cop. He had no clue and he has been on the job for several years. If the cops don't know, I have a hard time thinking you would get in any trouble for it.
I'm not a fan of distractions while riding in the city or other traffic areas, but out on long highway stretches I might be tempted to plug in. Mostly I like to solitude of just riding.
There's a thread in Gen Chat today about earbuds and someone kindly posted this link about state laws.
Not sure how a com-headset is allowed but other headsets aren't. They both technically limit hearing.

Wearing a headset or headphone which would impair that person’s ability to hear, or any device which impairs a person’s vision, is not permitted while driving. Exempts headsets or headphones used for communication purposes.
my headphones had a button i can click on to pause the music when i'm in town. that way i can just click the button to unpause the music without having to pull out my phone
