hey guys a buddy of mine told me about article he read in US today.It appears that a man defending him self against a intruder in his home,had a felony charge while back.He ended up shooting the intruder,he gets arrested for owning a handgun.Guess if you made mistake in past your surpose to let someone breakin,kill you . rape your wife and kids which isnt as important as you had felony charge.
The guys Lawyer is arguing that the constituion never said you can bear arms unless the government says ,ok now you been bad boy and can t have a gun.Ok myabe not lawyers words.The article stated that if his lawyer wins the case it will have huge effect on gun laws,but this time in very positive way.
If you think this guy should be aquitted for his defending himself and nothing else PLEASE WRITTEN OR CALL your congressman.senators and anyone else who will listen,the more public surport the better.
Yes I have big interest in this.Due to a felony speeding Im not surpose to own handgun,althought the courts had mine returned to me after court case was over.By the way the only reason eluding one bullet barney is felony is because if cop is chasing a fleeing felon and crashs him its ok in public veiw.Even if its a guy who just was running little over speed limit or was litting the tires half way thru first gear.man these people are such a minist to us all,not like those who might break into your house and rape your wife or kids,they just need food right.maybe some jewlery or just need some fun with someone who doesnt want them around.
So speak up and if you think im full of sh___ thats your freedom too.But at least we hstill have that one ,so far.

The rights to defend yourself should end because of a past crime. If you did the crime and you did the time, the Government does not have the RIGHT to take that away from you. But they do it anyway. Just another step in taking away every citizens rights to carry arms.

well, if it Washington state, here's how I understand it from my neighbor, who was convicted of a felony about 20 years ago. He says he can own a gun, just not a pistol. He has a shotgun for home protection but had to get rid of his ACP. So, while they are not taking away a felon's right to own a firearm, they are limiting them. For some past felons, that may not be a bad thing. For others , an injustice.

I agree that some dont need a gun.But if he can have a shotgun then whats he going to do with handgun that shot gun will not do.If i had to make a choice Id rather be shot at(key word) with one .30 cal then with 12 of them.Again if its a law to keep criminals from doing it isn't it kind of pointless.We dont call them criminals because the laws mean hell of lot.As far as im concerned if your justified in pulling the trigger then by dude have good night regardless of anything else.You acted in responsible manner.But then I think all liberals should be hung for treason,just my opion.

IMO, if you are in your home, it shouldn't matter if you're a felon or not. I think we all ought to have the right to defend ourselves and our families.
Now, some states say your vehicle is an extension of your home - if the gun never goes any farther than from you home to your car and back, I for one would have no problem with the felon.
But, every one says we ought to practice with our weapon, does that mean the felon can now go to the range / woods and pop a few caps - do you see where this is goin?

This is an interesting thread. There's obviously no right answer for all cases. I know some of our forum members are LEOs or former LEOs - it would be interesting to hear their take on this.

well do you think all felony charged folks are a danger.my felony was speeding to elude.no one harmed,no property damaged.no one attacked.Its not voilent crime like the word suggest.Maybe we need another way of deciding like the type of charge.By the way here in nc felony speeding is more than 15 mph to elude an officer.Plus if you robb a bank and dont get caught for 7 years your home free.shouldnt there be a time limit as to how long one mistake can be held over your head.heck get laid make baby and 18 years later your free right(yea i know but its joke).Either way thanks for responding

That's exactly what I mean't by no right answer for all cases. Obviously if you had robbed a bank with a gun, we would be idiots for letting you have one now. Its kind of like the saying 'once burned, shame on you, twice burned, shame on me. My neighbor was in his early twenties at the time he got busted for selling dope, now he's in his early fifties - he's obviously not the same person he was back then.
Its a tough issue and does not have easy answers. Could just be a state thing too. Some states (Idaho??) might not be a strict on some past felonies. NC? I grew up in Virginia - couldn't wait to get the he!! out of there- head west young man!!
As for the felony 15 mph over the limit - I'd be phucked in a heartbeat on that one...I break that one every day on my way to work.
Kind of related topic - we just had an incident in a town near where I live. An ex-con, who was released from Massachusetts after serving his time for killing his mother (nice guy), comes out here, marries his female pen pal from prison, and promptly shoots and kills his two neighbors over $50. Nice.

While there is no answer that will be just for everyone, the law is there for a purpose. The intent, while it is not real effective, is to give law enforcement a tool to try and keep guns out of the hands of criminals, or in the alternative, a means to get them off the street if they chose to have a gun.
While all felony convictions do not involve violence, the person doing the crime is usually well aware that what he is doing is a crime, and he choses to do it anyway. You make a bad choice you pay for it, sometimes for the rest of your life. If there are no consequences for bad choices, people will ignore the law and anarchy will be the order of the day.
I am one of the biggest proponents for the 2nd Ammendment that you will ever find, but I feel that you give up rights, includingyour 2nd Ammendment right when you chose to ignore laws and commit serious offenses.
