If this is a factual report. That bike needs a new motor. And that’s what I would insist upon. And they are available, at least in the US.

Did this bike have a modified motor or aftermarket tune?

That's what I requested 2 weeks ago, apparently here in Oz there is no stock! I waited four months for the bike so don't doubt it.

As stated consumer law in Australia trumps the warranty

Exactly the company and the dealer just keep going around in circles, I've started the legal process.

I stopped by a dealer near me on Saturday and they had 2 new bikes on their floor, that was it. They can not get any more 2021 bikes and have to wait till they get their 2022 shipment in Jan

The parts guy was saying, if he didn't have a part in stock he probably would not get it till April
I spent $40,418 on a bike that lasted 440ks and you'd be happy to wait 2 months instead of your consumer right to a refind? Better man than me

No picking on you just would like clarification. The factory does not actually do warranty work, they have authorized dealers do it and they reimburse them for the cost of the work. Not sure about the "can't afford it" comment. As far as waiting two months, I took my Road King in for a new battery and a 10K service and was told to bring it back in two weeks. They were that backed up and no room to take it in because of bikes waiting on parts due to the supply chain issues.
The dealer stated they can't afford to refund me, the repairs will take 2 months.

Apparently Australia has much stronger consumer protection laws than we have here. The dealer saying they "can't afford to refund your money" sounds like the dealer's problem to me.

The 114 Heritage in Australia is 30K drive away and yea by the way this morning I rang HD Au warranty in Sydney and there might be a 2021 Heritage in the system for a total engine warranty that we couldn't find but we didn't find it. There's no other Softails in warranty for similar either , nor baggers.lol
