Technically your bike was repo'd and its not on the repo list - that is called grand theft 'auto'. You need to report the bike stolen and found. My gut is the repo'r is going in the wind and they aint gonna pay for a thing. You may have to have an insurance claim to get this right. The good news is its a non-chargeable to you and the Ins Co. will subrogate the damages having no impact on you. You need a police report. We have seen this at the firm more than you'd think..

That's not wrongful or negligent anything..... that's THEFT and VANDALISM... You shouldn't have to fork out a deductible, make a claim and then have your rates go up for damages they caused to your bike, no way in hell. That company and that driver should be the ones footing the bill and paying for you a comparable rental bike in the process. I'm not the "jump on their desk" type but man, these repo companies have zero regard for boundaries or respect for personal property. I know it comes with the territory but they screwed the pooch here, not you. Time for them to pay up for it.

Another thing to consider is the value of the bike if it's denoted as a "theft recovery".
In cars, these situations are reported to Carfax and this DOES lower the value of the car after the fact. If in fact the OP reports this as a theft vehicle he should be able to go after the repo company for "diminished value" of the bike.

Repo can be idiots sometimes. My motion lights caught someone in my driveway next to my new truck. They were looking for a truck 10 years older from next door, that wasn't there at the time. Long story short, it ended with me standing over them with a baseball bat when the police arrived (and no...I didn't have to actually use it).

I doubt that the PD would take a crime report...no intent to steal. At most, an information report or incident report.
This was an unfortunate situation, but no need to blow it up to mammoth proportions. The tow company made a mistake, they probably carry insurance for this sort of thing, go thru whatever process is required, it's' not the end of life as we know it.
