And the second the dealer sees those fiber washers any chance of them ever covering that under warranty is gone.

Unless there's more to the story there's no reason it shouldn't be covered.

Just take it to another dealer that will take care of it

I didn't see anywhere you mentioned what model and year bike you have. Apologies in advance if I missed it. You did mention you had an ESP.

I don't know how warranty in CA works, but if it's like the warranty in the US- if the bike is less than 2 years old the factory warranty would cover an approved repairs.
After 2 years old, your ESP would apply until it expires- The ESP Isn't backed by HD, but by some other financial outfit.

Regardless, you should have been given a reason why they won't fix this under either your warranty or your ESP. Was a reason given, and what was the reason?

Did the dealer actually submit a claim under your warranty or ESP? Or did they just wipe off the oil and send you away?

The H-D warranty department may have a policy where "seepage" is normal. If you are losing less than 1/2 quart or quart(whichever thir spec is) they may not pursue it. You may have to wait untill drips are on the ground. It is 'seepage" vs. a leak. It is semantics, and based on definition. If the MoCo fixed every "seepage" leak that came in the door, they would be bankrupt. Not saying you dony have a valid complaint, Im saying the MoCo isnt going to fix it until it fits their definition of a valid claim. keep an eye on it, when it gets worse, take it in, or cough up the dough and get it fixed. You could probably get gaskets and do it yourself...

The dealer should fix it,period but with that said I think I'd get a torque wrench and tighten them up myself according to the torque setting & see if that stopped it.You don't have to be a mechanic to do that.

The rocker box bolts on my FXR constantly needed to be re-torqued over the years. That may be the issue.

^^^this^^^...you shouldn't have to go somewhere else, but another dealer will most likely fix it under warranty.

And tell your original dealer to kiss your ***(after it's been fixed somewhere else)...............

I have been lucky, none of my 05s leak......well not at the rocker covers anyway.
