rear ended on heritage insurance won't pay
 
I was ridning my 09 Hertiage, and was rear end by a Nissan Hardbody. this happened a week and a half ago. Now I am trying to work this out with her insurance company as I do not have the money to pay for my deductible from my insurance copany. I did everything that the other insurance company wanted, provided a copy of the police report, gave them my insurance info, got estimate by dealer ship. Now they said they can not pay until they talk with the owner of the truck and the driver. Well they talked to the owner, and she said that the driver had permission to use the truck, so the insurance will cover the driver. but when they tried to talk with the driver she said she was at work and can not talk at that time, and now will not answer the phone when they call. I argued with the agent, why do you have to wait for her statement she was clearly at fault as she hit me from the rear. He just said that they need her side before they pay. What would you guys do in this situation, they really have me stuck between a rock and a hard place.

Call the Dept of Insurance in your state. It's free and easy and they will kick start the company.

You could also talk to your insurance company. I had a similar problem with my car, they were clearly at fault. I got nothing but stalling from their insurance, so I called mine, I guess they used some kind of inter insurance leverage, because the other guy's insurance started to play ball after that. Good Luck, and stick to your guns.

Yep, call your insurance company their lawyers will deal with the other company's lawyers.

Good thing it wasn't a govt. vehicle. Had one back into my wife's bike while it was parked. Can't get much more clear cut than that. But apparently there's something in the law that says they only have to pay your deductible. Had to go through our own insurance and it was a full year of waiting before the govt coughed up the $500.

Our insurance company (Progressive) was great and I think we made out better with them anyway. They worked hand in hand with our dealer and replaced every piece on the bike that had even a mark on it. No questions asked and they did all the dealing with the govt to get our deductible back.

Had a similar problem a few years ago, when a drunk driver hit my parked car. It wasn't her car and when the police got there she wasn't in it, and of course she "couldn't remember" so I had to pay the detectable. It was such BS the lady got arrested for DUI but insurance couldn't get a statement so they could prove it.

Yeah if the owner says they didnt know that the driver had the vehicle then the insurance company doesnt have to cover it. at least thats how it is here in IL.

yep, call your insurance company and let them know the info you supplied to the other guys insurance. They will be able to light a fire under their ass and get this moving.
