Sam, thanks for posting this. It'll be good to review and have on-record for those of us with a dog in this fight. And admittedly, I'm no lawyer, so I can't and don't know how all of this will eventually stand-up at the end of the day. But I know one thing for sure . . . CD's are not the be-all, end-all, of legal wrangling or legal authority in this country. At least not yet. They've been repeatedly deemed unlawful and nullified across the country, many-many times over the years. We can just ask the tribes! And that's because the EPA and/or CARB are not courts of law. They're flexing their muscles and throwing their weight around the entire country of 49 other states on this deal, predicated solely on "California-based" emissions standards, because to-date, they've been allowed to do so. End of story. Those who've lived in California already know. These outfits are functionally no different than a well-organized criminal enterprise runamuck, and its likely to stay so, until someone, somewhere, stops it in its tracks. If and when it happens, I doubt I'll ever benefit from it, but I strongly suspect that this CD (as written), has a better than even chance of being thrown-out by the courts at some point in the not too distant future. Not fighting words and not meant to take a side or agitate the discussion here. Its just my 2-cents.
