That's not the decree. If you install non EPA compliant components, it voids the warranty, and m-m does not apply to non EPA compliant modifications.

It's illegal to sell a new motorcycle with non-EPA certified compliant exhaust and tuners on it. A franchised dealer is opening itself up to all kinds of trouble and fines in doing so. Big mistake on their part.
Harley Davidson paid a $ 12 million fines in August of last year and is ponying up another $ 3 mil in addition to that as settlement. Read about it on the EPA website:

There's some confusion in this thread. There are 2 issues being mixed.
1) the install of a non-EPA exhaust. The non-approved exhaust has nothing to do with warranty claims. It has been illegal to "tamper with the exhaust" since the 70's when the Clean Air Act was passed. Yes fines could be levied by the EPA but they have never been applied to a motorcycle exhaust manufacturer let alone the owner of a bike. If eliminating aftermarket motorcycle exhaust systems mattered to the EPA they could have shut them down any time over the past 4 decades. They haven't. The aftermarket exhaust has no impact on your HD warranty.
2) Aftermarket tuner. Now this is a new issue as of August 2016. In the 4yr Consent Decree between the EPA and HD, the MoCo agreed to deny warranty claims for drivetrain failures (non drivetrain claims are not impacted) if HD has "information" that a non EPA or CARB approved tuner was used on the bike. This contract with the EPA expires Aug 2020.
If this bike has a non-EPA approved exhaust but was tuned with the HD Pro-Street tuner (or no tuner at all), then HD will be compliant with the Consent Decree (all warranty claims can be honored). The bike will be out of compliance with a 1970's law that no one, including the EPA, has ever enforced on motorcycles.
The only issue I see is dependent on your State's motorcycle inspection procedure if they check for epa-approved exhaust on a motorcycle. You might fail inspection, however I've never heard of a State inspection code that checks motorcycle exhaust.

Since we all know that this forum is monitored by Harley Davidson and possibly the E.P.A. and maybe the Russians, I won't mention the dealers name here. I just thought it was remarkable that that new bike had a replacement exhaust system sans cat. I'm not a snitch. I was curious if this could in some way be done without affecting future warranty claims.
