EPA can over ride anything it wants and has done so. By making it an EPA issue Magnuson-Moss loses. When EPA set it's sights on HD they were screwed . Blame dealers all you want it is voters you need to blame.

OP No!!! What you need to know is that the judge in the consent decree between EPA and H-D in very specific language states that H-D does NOT have to show the warranty claim was due to an aftermarket device.

In other words the Federal Judge "Voided" Magnuson-Moss for 2017 to 2020 models of H-D. Some would say that is legislating from the bench but Judges get away with it every time. It is the wording EPA wanted to indirectly affect aftermarket companies selling tuners.

It will be interesting to see if there is a drop in ESP sales on 18+ models over the next few years. Of course correlation doesn't necessarily equal causation; but it would be mighty coincidental.

I want to believe HD corporate and their attorney's have a strategic plan here beyond acquiescence to CARB and EPA.
