It's your tuner not the bike. My best guess only as I know nothing. Just ask my wife.

Also H-D will not do any warranty work on a bike with an aftermarket tuner even if the dealer installed it. It simply is not their problem. It is between you and the installer.

Most know not to mess with tuners until after the two year warranty is over.

Could be a faulty sensor, but they all run too hot. Nature of the beast. 99% of all Twin Cams and M8's run too hot for their own good, straight from the factory. The fact that they keep running does not mean that they are not slowly succumbing to accelerated wear, resulting in less power (that most never feel because it is so gradual) and lowered longevity.

I have an FP3 that I just use to show engine data. It can't be used to alter the tune on my bike so don't turn me in to the warranty police. My bike was actually tuned with a SEPST. Anyway, my engine temp will go over 300f, even at 40 degrees ambient during extended stop and go riding. The oil temp, by the way goes to only about 170-180. If I am moving steady at any speed, the engine temp stays around 240 to 250. The oil temp is around 140.

I have the EITMS disabled during the winter because I want the oil to get hot enough to prevent moisture buildup. I think that if your EITMS is kicking in after stop and go for a while, it's not a problem. If you are seeing temps in the 300+ range during cool weather while moving at 30 or more mph, you probably have something going wrong. I don't think you should be seeing temps more than about 200-210 degrees above ambient if you are moving.
