Bike running bad, dealer says its me?

You never want the revs below 2500 rpm on these motors.
But to the OP there is something wrong other than shift points. You need a tune, and it doesn't sound like the cheap tuning solutions would work in your case because they all add fuel. It sounds like your's is already running rich, or at least at idle anyway.
Maybe try to get the dealer to reflash the stock map at least. It sounds like your's might be corrupt or something.

forget that dealer and everything they have told you. do not ever go back.
find a dealer that has a dyno and knowledge.
pay to have the bike on the dyno without a tune and then have a tune after...you will see the difference. pay that dealer and be on your way.
forget the bs with the original dealer and what they should or should not do....its not worth the stress. get your bike fixed and go riding. learn from this experiance....its always better to spend a few bucks just to be done with an issue and no more stress.

Some tuners rewrite the memory of the ECU and are not actually attached to the bike. Harley's tuners is like that, as well as a few other. You may not have a piggy-back system that is actually physically connected.

If it is running rich, maybe the fuel is not atomizing properly and it could be dirty injectors or maybe the spark is weak. I would check the spark. Not sure how to check injectors except to R&R them and send them out.
When you say "dealership", who do you mean? The Service Adviser, aka moron or a mechanic?

Brother, if your bike is under warranty, call Harley corporate first thing in the morning and tell them you want to open a case. Get case number. Discuss the problem with them and ask them what they want u to do. This way a$$hat dealer can't charge you for anything cause all you want is a safe running bike, be sure to make it clear to corporate the same thing, you just purchased a bike and want to ride safely but cannot the way it was delivered to you.

My shift points are:
1 to 2 @ 15
2 to 3 @ 30-35 (depending on how traffic is flowing)
3 to 4 @ 40-45 (depending on how traffic is flowing)
4 to 5 @ 55-60
If you are trying to go into 3 before 30 thats way too early. I also agree if your smelling gas it has to be running way too rich. Someone messed with the ECU, whether it was HD or the "harley mechanic" before he traded it in. Thats probably why he traded it in. He screwed up the bike tune and couldnt figure it out so he traded it in.
Lastly, you put down 2K and still financed 8700 on a used 09? That seems a bit high. Could be another reason the dealer is hesitant to work with you, they already took you to cleaners and don't want to eat their profits fixing a bike they new was suspect. I bought my 09 used in 2010 and only paid like 9200 including taxes. Even with the warranty that's highway robbery if you ask me!
