I have even thought about pulling the derby cover to check fluid level.
It's primary fluid behind the derby cover, a completely separate system from the transmission. There's a dip stick on the filler lid on the right side of the bike for the trans. It never hurts to check.

EDIT

Sorry, I didn't see you already had that covered.

Well it does sorta look like the operator was trying to get a little air under the front tire banging 3rd gear..

One thing to note.. All the tranny gears except the anti rattle first are the same as a later twincam.

smiling---its all good bro

I do know the diff between tranny and primary.

The tranny was slightly low.

So yes I pulled the derby cover-primary was ok.

Here is the funny part, I have changed all my own fluids for years and on different sleads. I always measured what I was putting in the tranny and primary. I'm not sure I have ever just checked the tranny level. Never had an issue with one. Always knew I put the right amount in, so I just screwed it back in and forgot about tranny level.

So I was not really clear if you had to screw it in to make the O ring touch the case or just lay it in there and then check it. I figured out you HAD to screw it in. If not my dipstick would have not had anything on it. It was just on the low safe side, not really low low. But vI added enough to get it up to the center of safe mark.

On the older models you don't screw in the trans dip stick and the bike has to be upright, not on the jiffy stand.

The OP mentioned "short shifting"...but even that I don't see how the gear could be nearly completely stripped...particularly with a constant mesh transmission.

Still hoping to hear from Mark at Baker,

IMHO...I'm betting something was missed in the heat treatment of that gear. Maybe after break in, everyone should bang out the gears hard to see if your's has this issue,

ouch that is really scary. please let us know how you make out. I'm sure HD will fix it but would be nice to know how the heck something like that happened. Obviously bad alignment/adjustment but could it be MoCo using cheaper materials to make these things lighter? if that's the case than I really don't think these bikes are going to last as long as we hope they would.

That really sucks on your new M8...
I hope to hell it's not a run of bad gears,,, get someone killed.

I totaled my '85 Sporty due to bad heat treating of 4th gear...
53 MPH in 1993 (10,210 miles) I hear a tink-tink then 10 seconds later Bang,,, damn thing locked up solid... the face of 4th gear was chipping out and finally a big enough
piece got caught in the Final and locked up...
