From the factory, they turn off automatically when the high beam headlight is switched on. You can ask your dealer to flash the control module to allow them to stay on. My dealer did it but I've heard some won't.

the way Harley wants you to wire them is jumper then to the highway ( passing ) lights I was talking to the parts people and they say they don't list a 2nd switch for just the fog lights but they are not the brightest bulbs on the tree and they did not know if the module will turn them on or not

A friend of mine is Patriot Guard he has added quite few non Harley lights to make his bike stand out almost like cops but only use them on escort rides. He wired all the lights into P&A ACC switches, I don't see why your shop would use passing lamps wires unless Moco made PNP harness to plug into passing lamps.

Maybe I'm missing something here, but I thought the OP was talking about the driving lights that are stock on the Ultra/Limited models. These have a dash switch to turn them on, but as delivered, they only work with low beam headlight & are turned off on high beam headlight, regardless of console switch setting.These lights can be programed by the dealer to stay on with high beam when the console switch is on.
If he is referring to the LED Fog Lamps, those are not stock & are an accessory that is purchased/installed separately. I have these installed on my '14 Limited & activate them with an additional lighted latching console switch added to the left console switch-pack, fed back to the BCM & the lights wired to the direct (no relay) accessory plug under the seat. Installed this way, they work completely independent of the headlight high/low switching.
