Default First accident

I was involved in a accident today in which the driver of the car that hit me was at fault and cited. My motorcycle insurance is paying for the repairs to my bike but does not cover the rescue ride to the hospital or hospital bills and any subsequent treatment. The person that hit me has insurance and was driving a company vehicle. My question for any body with experience in this is his insurance liable for my hospital bills and days off from work? Im not a sueing type of person and was not seriously hurt but dont want to get stuck with bills when it was not my fault. Any info would be appreciated.

I think it depends on your state insurance laws. His insurance should have to pay for everything, including your bike. Expect them to make it a real pain in the *** though, because that's just what insurance companies do. [:@]

Can't see where you are from, so I can't say for sure. If you are in a "No Fault" state, it is my understanding that each person's insurance is responsible for their driver.

In my state of New Mexico, the driver at fault is usually responsible for all damages, including injuries, time lost, and repair bills on your bike.

If this was a company vehicle, and the other driver was at fault, I would guess that they will pay all your expenses. Especially when they realize that you are not going to sue and try to take them to the cleaners.

I'm sure you will get further insight into this shortly.

I hate to say this, 'cause I don't really like lawyers...but I would get one...he'll make money, but you won't pay...

I agree, get a lawyer. I am going through it now. Haven't paid anything out of pocket. All bills are sent to the lawyer.

Even in a no fault state when one driver is legaly to blame for the accident THEIR insurance should cover your bike/car, medical expenses and lost wages. Did the other guy get a ticket for causing the accident? Your insurance company will more than likely pay for your repairs then go after his insurance company for that $. YOU need to cnotact the other guy's company RE: your injuries, missed work etc. Depends on the company as to how fair they are. I was recently in a accidnet in my truck, other guy's fault, and his company was more than fair and quick with the settlement.

I went through a similar case some years ago in Texas..Their Insurance paid for lost wages .Insurance rules Yours may pay as well..Get all you can from them but Do not accept a settlement until all bills are in and paid.My case involved State farm ins. I received 6 wks lost wages ,hospital costs , and after it was all ocer I pressed ever so slightly for a settlement .This part is in the liability clause of most auto policies and they HAVE to pay it,but dont tell you that..It is easily done but will only pay the amount that is in the polocy .Any thing above that ,you have to sue for...it was really simple top do.Just make sure you accept that you are fully recovered before you sign anything ,You can also tell them that you may not be able to do the same work and recover re education in another line of work..I did not use an attorney ,Not needed. Save any and ALL receipts and wage vouchers ...Hope you do recover though.You only have one life,but there are a million insurance companies.

Get a lawyer, especially if they were at fault. Thier insurance will not play fair with you.

dont worry to much you will get the bills for now but the insurance company will pay the bills when they get ready i'm going thru that as we speak mine happen in september and its not done yet they was real good about paying for the bike but dragging there feet about getting everything else taken care of and there client hit me in the rear my insurance payed the first 1000 dollars but have put a lien on the other insurance to get there money it does take time but trust me they get by cheap my work insurance is paying for now and with the discounts the insurance company is getting by cheap they only got to pay what my insurance company spent.its not right but that is how it is done .keep us up with information.[sm=biker.gif] P.S. glad you are ok

I've been through this AND I live in a "no fault" state. It was the other guys fault, he made an illegal left...

1st, I wouldn't get a lawyer UNLESS my dealings with his insurance went sour. No need to, IMO. Deal directly with his insurance to get your hospital bill, doctor bill, ambulance bill, towing, bike, etc... They'll usually pay up pretty quick when given the bills or copies of them. In my case, I paid the bills and they reembirsed me every cent. They will try to finalize all transactions quickly and get you to sign a waiver that they are no longer liable. UNLESS you are SURE there is no hidden pain and suffering that you'll encounter later, DON'T sign ANYTHING. As for pain and suffering... it is customary that you recieve 3 times the hospital bill... Now, go get your bills paid, you bike fixed and buy some more goodies! Just like I did!
