It all depends on the condition of the used bike. The pros of getting used is you pay much less. They often come with after market parts that are included in the price of the bike. You usually don't have to pay for the first maintenance. The cons of getting used is you could get a lemon. If you buy new you get a two year warranty and your the first owner. Harley no longer make the sportster 1200 nightsters so that particular bike you would have to get used.

I'd shop used. I just picked up a one owner 2004 Firefighter Electra Glide with less then 15k miles for under $10 grand. Didn't need it but I was able to turn it around fast. Bike had/has lots of aftermarket bits and do'dads, with a stock motor and was garage kept. Garage queens are everywhere for far less then new and ready for someone to love.
But, if you want new...make yourself happy.

Lots of people buying sportsters or nightsters and then deciding they want a bigger bike. I would think there is a good market for nice low mileage used nightsters and most will already have the pipes changed out. I think used would be the route to go.

If you can find a good used one that's the way to go in my opinion. That's how I found mine, less than 800 miles and in perfect shape with some nice additions and a great price.
