Note: H-D is under a 4 year consent decree signed in federal court NOT to warranty any of their bikes with aftermarket tuners. It was a result of EPA suing H-D about their own non compliant tuners. That cost H-D $15 million and they don't want to pay any more.
The denial does not require that the tuner was a result of the failure as usually required by the Magnusson-Moss warranty act. This is an example of judges legislating from the bench.
On the touring forum just read the rant by one member when he was denied a warranty due to an aftermarket tuner in place.
So if you do not care about the bike's warranty go ahead and put in an aftermarket tuner. But be ready to reach into your big boy pants for your wallet and pay for any problem that comes up. H-D will not and can not uphold the warranty.

I ended up going with the Vance and Hines Comp Series, awesome sound with sound dampener removed. I have a K&N air filter waiting for the 1K oil change. When I spoke to the dealer they did tell me there are other options like the V&H fuel pak but would bust the warranty. I will just wait for the 1k oil change and have the dealer do the tune. I paid for extended warranty, not going to go throw that money away.
I've had the bike for 2 weeks now and have put 500 miles on it, would be more but weather and work requirements sometimes necessitate taking my truck in, so...... I figure I'll be calling to schedule the first service next week.
