Default Mid control hitting pipe normal?

I've got mid controls and stock header pipes. The front header heat shield has the indent for room for the mid peg. I noticed that there was a dent in the shield at this spot, the chrome plating has cracked and is flaking off, and it has started to rust. I went to the dealer to see if warranty would cover it and I was told that due to the rubber engine mounts, when hitting a bad bump (which we have a lot of here in Maine, especially in the spring) that it will hit like that and warranty will NOT cover it. Is this true about the engine mounts and this hitting like that??? I've found a replacement shield on ebay but I'm hesitant to replace it right away for fear of the same thing happening. And a new shield from the dealer costing $200 (EACH!) I am concerned about this.

Can ya "clearance" the inside of the brake pedal to gain more room. A little grindy grindy and you may cure the problem.

I've hit some pretty good bumps that bottomed out the suspension but never dinged the shield. There is some room to adjust the exhaust from the head pipes back and that may work for you. However you do it, once you have it sorted out you can usually find heat shields on ebay or in the classified here.
