Mass S.1749 in committee for hearing 11/30 (very odd legislation IMO)

SECTION 1: Section 7 of Chapter 90, as appearing in the 1998 Official Edition, is hereby amended by striking out the entire sentence beginning with the word “Every” in line 141 and ending with the words “head gear” in line 147. SECTION 2: Section 7 of Chapter 90 of the General Laws, as so appearing, is hereby amended by adding at the end of said section the following new paragraph: Every person operating a motorcycle or riding as a passenger on a motorcycle or in a sidecar attached to a motorcycle shall wear protective head gear conforming with such minimum standards of construction and performance as the registrar may prescribe, and no person operating a motorcycle shall permit any other person to ride as a passenger on such motorcycle or in a sidecar attached to such motorcycle unless such passenger is wearing such protective head gear, except that no protective head gear shall be required if the motorcyclist is participating in a properly permitted public parade and is 18 years of age or older, or a nonresident motorcyclist or passenger of a motorcycle that is registered in a state that does not require persons to wear a motorcycle helmet while operating a motorcycle.

Here is companion/counter legislation from the House

Mass H.2642 in committee for hearing 11/30 (other state laws use a rider's course)

SECTION 2. Section 7 of Chapter 90 of the General Laws, as so appearing, is hereby amended by adding at the end of said section the following new paragraph:-

Every person operating a motorcycle or riding as a passenger on a motorcycle or in a sidecar attached to a motorcycle who is under the age of twenty-one years of age must wear protective headgear conforming with such minimum standards and construction as the Registrar may prescribe, and no person operating a motorcycle shall permit any other person under the age of twenty-one years of age to ride as a passenger on such motorcycle unless said passenger is wearing protective headgear unless said operator has completed a motorcycle rider education course approved by the registrar and is not under the age of eighteen years of age.

Ban loud pipes and allow you to ride without a helmet?

****, I may move back there. I got sensitive ears anyway. Too much rock music and loud pipes.

Heard this on a local talk radio show this morning.
One of the hosts was for it one was against it.
I say let the rider decide.
Funny thing was allot of people were more in favor of banning loud pipes.

A lot of folks may not be aware of the population density in Eastern Massachusetts. Also there are many motorcycles in that state. Any day or time during the week, even in colder weather, you will hear the loud rumbling of V-Twin engines. Sure a lot of us like that sound but for for many, they despise the noise. A lot of things like aircraft, small engine tools, and music is harder to control. But motor vehicles are shipped from the factory nice and quiet, so the authorities can point the finger at loud pipers as the ones who can control the sound levels but they don't. that goes for those loud automobile mufflers too.
I think it's a good trade off letting riders go helmetless if they want too as long as their bikes are more quiet. Flame on ....

Well....good luck with that. Here in Oregon, we've tried axing the lid law (or at least modifying it) for years with zero success. And I believe your legislature is somewhat more nanny-state than ours is.
