Mine is going too. I have to press the pedal harder and harder to get it to come on.
Funny, I was just researching this topic yesterday on this site and found this posting, which has some good info.

I just had mine replaced too. It was staying on. This caused an ABS fault and cruise control also wouldn't work. My check engine light stayed on also. I thought I had some big problems but it was all tied in to the brake switch. New switch and all the other stuff was fine.

When mine went out, the first sign was constant static on the radio. I had just got back from a ride. I assumed I had a radio problem. I started searching for antenna and ground problems. After a short while, the static only happened when I used the rear brake pedal and I figured out the brake light didn't work when I used the pedal. That clue lead me to the rear brake switch. Before I could get to the dealer, I found brake fluid under the bike. It was replaced under warranty.

2009 Ultra.
My rear brakes failed yesterday 150 miles from home....melted switch.

Taking it to dealer tomorrow.

Easy fix and no need to bleed the brakes. Just depress the brake pedal when the switch is lightly inserted to let the air out. autozone Duralast #RB401 with lifetime warranty for $13.49!

There's a recall on some years/models. My recall replacement failed as well, go figure.
