Alot is being made of the fact that under the new law the helmet has to meet the FMVSS 218 specification, but that is already a requirementfor DOT certification, it's not an additional requirement.
I guess part of the problem in NC arises from the fact that they are looking for the FMVSS 218 label, which is located inside the helmet. Checking the label would require a demand by the LEO that the helmet be removed and that would require either consent or a search warrant.

It does not have aFMVSS 218label or taganyhere on it, .
It has DOT on the back of it and the obligatory "personal injury warning" tag on the inside and that is all.
I ride thru N.C. quite often (as a matter of fact, I just rode thru there yesterday), so if they're looking for this "tag" on mine, they aren't going to find it.

First, I live in FL and am glad this is a "Pro Choice" helmet state. I ride in NC several times a year and they have had a helmet law for years. I guess what I didn't know was that to-date, anything on your head apparently has qualified as a legal helmet in NC.

All I got to say is LEO tickets me I know its his job and I will not hassle him. I am sure he doesnt want to do it anyways since a lot of them ride around here. I will fight it in court even if I loose every time just to take up the courts time and I promise to take as much time as I possibly can with the case. I will work hard arguing the case just to try to drag it out to the length of at least two cases if not three or four. I want it to be costly for the courts time. I might even get an attorney and instruct him if you cant win then waste time and lots of it. If all the bikers in NC do this then they may reconsider the law after a few hundred cases. If we are going to loose then make it tuff on the court. They will catch on quick to our actions I promise you. The judges will hate to see Helmet Cases. I do not plan to give up my helmet because it is DOT approved even if the DOT sticker is a stick on instead of sown in.
