The U.S. Code governing HOV lanes--

Title 23, Section 166 (23USC166)--states agencies that govern HOV lanes must allow motorcycles to use the lanes unless they prove motorcycles pose a safety hazard on the lanes, and that proof is accepted by the U.S. Transportation Secretary following a Federal Register notice and public comment period on the ban.


This is the Governing code that New York City is refusing to follow.

Sorry you're having a problem there. I've been riding in the special lanes for many years without any problems.

AMA has been highlighting the HOV issue in NYC.  Supposedly the NYPD claims that MC in the HOV lanes are "safety issues" .  I have no problem if that's what "they think but then they need to go through the proper steps and clearly demonstrate their "fears' with the DOT etc.  I wouldn't be supprised if there isn't a class action lawsuit if NYC cannot pull it's head out of it's A$$. 

Maybe some people there need to schedule a "FREEDOM RIDE" on the HOV lanes.  If the legislature cannot come to their senses then maybe by cloggin the courts with a couple hundred HOV cases then that should wake them up.
