There's your answer. Should start in gear with the clutch pulled. If not, the switch is bad. Though I haven't heard of a Twinkie dying just from a clutch switch...

Okay folks, some of you nailed it. It was the clutch switch. If I had posted this Saturday morning when I got to the shop I could have told them what was wrong and got it fixed then. The dealership is closed on Monday but I messaged the tech (personal friend) and told him it was either the switch or tune and I leaned towards the switch because it only did it with the clutch in. First thing this morning he test the switch and the rest in warranty history.

Side note, what the hell does the switch do that it could not live without. My '86 has no clutch switch and it's been kicking *** for over 30 years. The switch going bad actually causes a serious unsafe condition. The bike shuts off in an intersection then will not start back up until you stop and get it into neutral. Seems like that would outweigh any benefit. I guess when it's in gear and the clutch is out they don't won't someone hitting the start button and lunging forward. Big woop, done it a bunch without issue over my 45 years of riding. That is only embarrassing, your bike cutting off like that is dangerous.
