Like others have said, the smoke has little to do with it. A rear facing red light is a rear facing red light no matter what color the outside lens is. My understanding is the reason a lot of them are technically illegal is because you no longer have a rear facing red reflector.
Technically, you should look up the law before telling someone it's illegal when it's not necessarily. After all, some cars come with OEM tails, so it must be illegal!
Sorry, I was just going off of what a friend of mine was told as an officer. Tints vary state by state, but exterior illumination cannot be altered or light discharge reduced legally. Just passing the word along from what I heard, no need to be a jerk about it.
By the way, ALL cars come from the OEM with tails.
I can't speak to the legality, but IMO, even though I agree the Smoked looks better, I think the Red gives you a little better safety factor.
I've got the Bal-1 and thought about the Smoked when I bought it, but decided to stick with the Red.
People just associate Red with "stop" more than they would Smoked.
I've got the HD Led Headlight and Passing Lights up front, and I did go with the Smoked HD LED Turn Signals cause I think they look better and I'm not as worried about Front Lighting. For the rear however, I'll sacrifice some of the "cool factor" for safety.
If you change to a smoked lense then you must change to a red bulb setup - stock bulb is clear. I've got a smoked rear tail light on my Heritage that has a mass of little red LED bulbs. When this thing lights up it's red as red can be - and much brighter than stock.
Technically yes. They are illegal. Will the police make an issue of it? Depends on the LEO. I personally smoked the tail lights on one of my cars, and have aftermarket headlights that are smoked. Illegal, but not ever had an issue with them.
imo it would look better if you finished the rear & did the third brake lens....IJS

We may be 'technically' in the right, but a bored traffic cop can still ruin your day over it.
Personally, I'd print out that states law and keep it on the bike somewhere. It'd be great to pull that out and show the cop.
