OK, I just Googled it, What a **** poor design. Anyway, new neoprene gasket and sealing washers on the outside of the derby cover should fix your problem.
... It has some rash on the lower primary ... The outer primary cover seem pretty straight the bottom but it is possible the bottom might have a slight curve but extremely hard to tell and without looking at another sportster primary I can't tell if that is normal. .
You mention rash on the bottom of the primary and that it might have a slight curve ... the PO could have dropped it harder than you thought and your leak may be because of the primary instead of the derby ...
if possible, try the derby on a friends Sporty and see if it leaks on theirs ... if it doesn't leak on theirs, it's not the derby ...

I was thinking it might be the outer cover but don't see any warping. I don't believe it the clutch oring. It pooling up by the bottom hole area. I need to take better pictures. I'm working midnight and last time I got annoyed after it leak and walked out of the garage plus it was getting cold and today it's snowing. I did order some JBweld black gasket sealant, that will be the final option. Too expensive to replace the outer primary if some gasket sealant will fix this problem. But I prefer to figure this out the right way.

Replacing the primary cover is cheap. Get a used one and a new primary gasket set... but, before any of that.
Get a new gasket from the dealer for a few bucks or order a cometic gasket and replace the hamfisted gasket. Getting it to sit right takes a little work the first few times you do it. I have a stock polished derby cover (it has been living in a box since i moved 4 years ago) i can send you, free.99 if you want to double check the derby cover as the source of your issues.
If you still have a leak, go from there. And torque the screws to spec... just don't go HAM or work on it while it is hot.
