Angry Myrtle Beach

I know this isn't the right place to post this however. I have in front of me an ordinance, number 2008-64 that states anyone riding a motorcycle within the city limits of myrtle beach shall wear an approved helmut and protective eye wear. I went to myrtlebeachbikeweek.com and printed this off...after I picked myself up off the floor. Someone smarter than me needs to review this and see if it is legal for them to do this. I'm no lawyer and haven't a clue!

Hmmm, got any idea why they're doing this? Think maybe it helps drive the Bike Week crew away. That's what they really want. NO BIKERS AT ALL!!!!

I doubt the helmet law will stand up in court as local laws cannot supercede state laws

here is a summary of them


Amend existing Nuisance law found in Chapter 10, Article II, Nuisances of the Code. The effects of an unpermitted special event, or rally are a public nuisance against public health, public decency, peace and order, public welfare and safety and the public economy and responsible parties to be held financially responsible for public cost that result from their promotion.

this will allow them to control who sets up any kind of vendors ect..






2008-59 New law amending Chapter 14, Article 1, Section 14-1. No alcohol served between 2:00 a.m. and 6:00 a.m. Note substantial changes. Business can exempt from 2:00 a. m. to 6:00 a. m. sale prohibition upon showing of policy or practice that addresses among other things underage drinking, over-serving, internal and premises security. Exemption can be revoked upon events of criminality on premises of business.

they made a change to this requireing any bar that stays open after 2 am to have all of their security (bouncers) licensed and bonded


2008-60 New Law. Chapter 14, Article 1, Section 14-7. Defrauding a restaurant is a misdemeanor.

THis is for those who like to dine and dash

2008-61 New law. Chapter 14, Article X, Sections 14-220. Infraction. Administrative process. Short term rental, payers of accommodation tax, innkeeper or hotel check-in procedures; photo id for check-in; identification of all guests per room, identification of all vehicles; issue parking card.

requires license and registration for everyone staying in a hotel room not just the person paying for it

2008-62 New law. Infraction. Chapter 14, Article X, Sections 14-221. Administrative process. No alcohol consumption or open possession in parking areas, lots and garages. Business shall not permit.

no more hanging out outside of your hotel having a beer

2008-63 New law. Infraction. Chapter 14, Article X, Sections 14-222. Administrative process. Use of parking lot for non-parking activities a nuisance. No destruction of landscaped areas by chairs, etc. Businesses shall not permit.

this will eliminate anyone setting up vendors in their parking lots ect

2008-64 New law. Infraction. Chapter 14, Article X, Sections 14-223 through 14-227. Administrative process. Helmet and eyewear required for cycles and mopeds; No impoundment.

2008-65 New law. Infraction. Chapter 14, Article X, Sections 14-228 through 14-231. Administrative process. No trailers parked on public streets, or unlicensed private lots.

according to this you can't even park your trailer on your own property with receiving a fine


2008-67 New law. Infraction. Chapter 14, Article X, Sections 14-236 through 14-239. Administrative process. Minor or Juvenile Curfew: 1 am to 6 am.



2008-68 New law. Infraction. Chapter 14, Article X, Sections 14-240. Administrative process. No loud mufflers, impound serial offending vehicle.

there is nothing in this law that determines what makes a loud muffler
this would e at the discresion of the LEO

2008-69 Amend existing law in Chapter 14, Article V, Section 14-85, adding section (b) (10). No loitering on commercial lots after hours, or when posted.



2008-70 Amend existing law in Chapter 12, Article III, Division 1, by adding Section 12- 102: only 1 vehicle per space; Chapter 12, Article III, Division 2, Repeal deactivation of meters for bike parking.

they did make a change allowing no more than 2 bike to a space they did repeal the parking meter amnesty

I cancelled my trip down there
THere are too many other places to go and spend my $ that would actually welcome me instead of enacting laws like this
I understand there are a few ad apples in each bunch but I really hope all of these clowns that passed this have deep pockets because I don't know where they are going to come up with all of the lost revenue

The best thing that could happen is that a motorcycle NEVER sets foot there again. Let em see the financial impact. It's all about votes, and courting the old farts that have retired there. I'll never go back.

I had planned a trip there next week but that's out of the question now.
Sounds like the geezer drain pipe to Florida got clogged and it's backing up into South Carolina.
I'll take my $2500 someplace else.

I was just posting in a regional forum, I might make some calls and emails to the golf brokers and the top courses in the area. I know a lot of bikers don't golf, but I bet more do than some people think, and I wonder if the golf community (big business down there) thought they weren't so insulated from this mess, they might have some words for the local 'leaders' as well as some of the hotels, although it's tougher to get to higher ups at the hotels. It's not just the rally's at this point, I don't even have time to read the ordinances enough to understand them, making me just not want to go there for fear of violating some bs infraction. Like someone said something about some BS pipe sticker that no one would ever have, who needs the drama?

But I have memories there, and have friends that play golf there, and family that likes to meet other families there, and it's gonna be hard to get non-bikers to change their plans, and I don't want to lose certain connections, so it kinda sucks...

During the hearings a couple of lawyers with clients opposed to the ordinances questioned the constitutionality of the actions. The attorney for the city replied "We'll let the judges decide" It seems the city isn't concerned if they trample peoples rights.

On the helmet law. I thought the city could have a stricter law than state law, but not a more lenient one. For example, if the state required a helmet, the city must require a helmet. Although the state doesn't ban smoking in businesses, many cities do.

My parents live there, so I'll get to see how this plays out.
