I had ordered a behind the head version from this guy but my helmet kept pressing on them until they got uncomfortable. I think the earbuds would be great if allowable in my state.
Of all the things to worry about in our world today, the legality of ear bud use ranks pretty low in my book. My son in law is a fed and my son was a city police officer and I know they would not worry about this.
Think about running about 5 over the speed limit (except in a school zone).

I have been using earbuds for many years in just about all states and have never had a problem. If an officer had a problem with them, I would toss them in my saddlebag and pay the fine. And use them again as soon as I was out of his sight, lol.
