Sure. And your lawyers can fight that in court. Not going to happen. HD made a deal with the EPA (a government agency) and they are enforcing it. Good luck ignoring it and fighting the warranty void.
There's a difference between law (M&M Act) & bureaucracy policy (EPA mandate). HD cannot legally void a warranty simply because they find a tune UNLESS they can prove the tune was the root cause.

OP - Go with the Dynojet or ThunderMax from FuelMoto & don't look back. A buddy of mine went with the Dynojet & likes it because of its simplicity on the user side. I have a ThunderMax (from FuelMoto) since I plan to boost the bike & it's a boost friendly ECU.

Well, they're doing it and no one seems to be winning in court. Or even trying from what I've been able to see. So...
And HD will definitely void the power train warranty on 2017+ bikes if a non-HD tune is detected. Its documented. Check out the M8 forum, its all over it. I've also heard if anything other then HD slip ons are used - same.
Whats worse is even if you flash the stock tune back HD can detect that it was flashed. Not under normal circumstances, but if a big claim was submitted, they'll find it.

Also I may never do more than stage 1 to this bike so are both needed to be running at the bikes best? If and this is a big IF I go beyond stage 1 (after warranty is gone) I would end up with a powervision or power commander correct?

You don’t need both. The smart pro tuner is an enhancement, not a necessity. The dealer probably recognized your inexperience with HD (no offense) and took advantage of it.
Or, he simply suggested it in a way that you interpreted as that you needed them both. The SEPST will be fine for a stage 1 keeping you within warranty requirements. However you said “running at the bikes best” - the Smart tuner should definitely help get there vs. the street tuner alone. But as you asked, it’s not necessary.
Ask your dealer about this tuner. This is what I was recommended by the only mechanic that I allow to touch my bike. He’s a master tech at Heritage Harley in Concord NH. It’s dealer friendly and all the techs swear by it.

Problem is I think the OP has a 2017 bike still under warranty. If he uses the TTS and HD checks his ECM, they will void his warranty. If he wants to keep his warranty in place, he's got to wait until it's expired before he can use any aftermarket tuner. If he doesn't care about it, then there is a whole bunch of excellent options.
