While riding home from work yesterday a woman pulled out of a parking lot and BAM next thin i know I'm in the middle of the road on my back with the bike next to me still running at about 3500 rpm's but smoking and knocking. I came to my senses did a quick once over and I'm OK. I shut the bike down and picked it up to find that the impact had smahed the pipes tore off the mid controls and broke the top of the cam cover off, trahed the tins etc.... Well after a trip to the hospital for a check I'm realeased no broken bones but I'm sore as hell and bruised arms ankle knee. I called my insurance who told me to contact the other parties insurance to file a claim with them. my insurance (geico) would be more than happy to process the claim under my collision but again it was up to me to go after the other parties insurance for compensation. This just doesn't seem rite to me any one have any tips on how to deal with this? also how long does it typically take to get a bike repaired through HD any past expieriences? I am hoping they just total the bike, but I'm worried they will send an adjuster who will look at it and say it can be fixed only to find out later after work has begun that it won't be cost effective. any advice is appreciated....
glad to hear you're ok, i used to have gieco and dropped them after a similar experience, went with progressive and had another wreck with them, they've been great the whole time. both times it took about 3 months to get the scooters fixed, if you're looking to get a new bike and they total your 03, there's your down payment on a new ride, if you can fix it and you love that low rider, i say keep it as long as there is no damage to the frame.

Call them and tell them no, you're going with them, and THEY will go after the other insurance company. That's how it's supposed to work, and if they have an issue with it, you've got a lawyer. Works great. Most of the time you'll have to pay the deductible, and they'll go after the other for it, and you'll get a partial refund, but YOUR insurance company should be working for you, not the other way around.

I think what he is saying is that GEICO will take care of the bike if he wants. And unless the other person is un/under insured they are telling him to go after them for the bodily injury, which is correct. If the other person has not enough or no insurance, you will need to access your uninsured or underinsured coverage if you have it.
Get a quote from both companies before you tell them which company you want to go with. This is 100% acceptable. I do claims and people do it all the time. It sounds like the bike will be totaled...I had a much less claim than that on an 05 road king and it totaled. They won't do the repairs if it's close to a total because there are always supplemental payments for repairs.
the frame will probably determine if they total your bike-other wise they will probably just fix it if the damage is not high enough in cost-to warrant a total replacement value
You will have leverage on the bike repair if you go with her carrier. Your insurance will pay the value of the bike but no accessories usually unless you have paid extra for the coverage.
Her insurance should pay for everything up to current market value. Have all documentation and receipts ready to back up your claim.
Do not settle for lowball offer. Calmly state to her adjuster that you were fine and happy until the time of impact and that you are entitled to have the bike put back to exactly where it was prior to the crash or be compensated for the full value of the bike, all of it's accessories + any damaged riding gear or personal items lost or destroyed in the accident.
If you meet any resistance calmly state that you need to speak to his or her manager if you feel their final offer is too low and that you will let their personal injuriy claims adjuster (usually a different person) know who they were when you ask for double the injury settlement as a matter of principle.
I was cut off on the freeway on 12/25/05. I had a brand new bike by mid 2/06. Personal injury settlement check without the aid of a lawyer in my hands by mid 5/06.
Document everything and make sure they pay for EVERYTHING.
Sounds like you were 0% at fault so they should pay 100% to get you back to pre-accident shape both physically as well as mechanically.
THanks for the advice!!!! Not sure if she got a ticket or not I went to the hospital and had on of my bro's take care of my scoot. The main issue for me is uncle sam is uprooting me and family from Mississippi to California in 90 days and my bike is my transportation 24/7 rain or shine. So i want to get this taken care of ASAP but not get screwed in the end.
+ 1 on Progressive they paid for my repairs and then went after the responsible party's insurance
if they tell you that the tins will have to be ordered from factory tell them you want unpainted then get them painted locally. 4 months to wait for the factory to get my fender rear painted.
