We had the same thing happen here, at Cherry Point, MCAS. Some "witch" in a SUV Cage, on a cell phone, made a left hander in front of the couple. Killed the rider and sent his wife to the hospital on life support.
My argument to the judge would be that if the person says, "I did not see him", is that they do not need to be driving then. And, "Would it make a difference if that had been a child on a bicycle versus a biker on a HD." It's not that they did not see the biker, it's that they did not LOOK!
We also had happen here that the guy who teaches the MC Safety Course at a nearby Community College, had some make a left hand turn in front of him and hit him, he was on a bicycle during lunch, and paralyze him. The driver got of with an "Unsafe Vehicle Operation" and paid a $75 fine.
Here in College Station Tx. just Sat. night we had a driver hit and run a M/C rider here and killed him. This occured on a major road here. They found the car and have arrested the driver. If I was a betting man, this is what I figure= drunk driver, no dL and no insurance.
