If you can see oil in the bottom of the tank I would leave the tank cap off, start the engine and watch. If it starts returning oil shortly after it starts and the oil level steadily builds up there is no need to add any oil IMHO. Once the level has settled and if you plan taking it for a ride, by all means top off if necessary.
Thanks to everyone ! Tank was bone dry, I put 1 qt in and got it to fire up, 2 qts at least came out of the breather tube into the pan. Let it get warmed up and then did an oil and filter change. Runs great with no leaks, overfill issues or problems. Made my buddies day to ride it over and put it back in his garage all good to go for him. He still can't ride yet, but he's happy that it's running and he can at least go out and fire it up now with no issues. May plan a trike conversion on it depending on how he progresses with his recovery.

While I am Decidedly Not a Trike fan, preferring Hacks...I have seen the Training wheels utilized by folks with disabilities, as well as trikes...Wondering which affects the Value of the Bike in the least negative [maybe even a positive] way...The Training wheels route [hate to use that term, but it's all I can come up with] seems to change the bike iself very little.
But, You know about opinions...Right?

That's good to hear.
I personally respect a gent who gets a trike or training wheels instead of parking his bike.
I hope the day never comes that I can't handle a bike on my own two feet but if it does, I'll be thrilled to ride a trike.

I have heard of this issue since I have owned mine, and thankfully to this day I have yet to have it happen to me.
Somebody correct me if I'm wrong..but I don't think there's a drain for the engine sump (oil is not supposed to be there). So even if he wanted to, he couldn't have drained it.
Don't forget, most of the old oil dumped out the breather (the bike was a bottom breather) and he changed the oil anyway after it was all done.
Just to put a coda on this thread, is there any other way (apart from splitting the cases) to get oil out of the sump, or did the OP do it the right way?
