Your attorney should ask the officer if he is qualified to run the radar gun and prove certification, he should also see if the radar gun was calibrated and when it was done last. I would also ask how he identified your car as the 122 mph vehicle, if it was color, hope he is wrong. I had the exact same thing happen to me, another vehicle raced by me on the interstate, the cop was driving in the opposite direction, turned around in the median and pulled me over. I got off on these questions and having a cop who could not recollect a thing about it, not even the conversation we had about how he got the wrong guy. The officer could not verify which direction I was headed, had no proof with him that he was qualified to run the gun, plus I was traveling with a whole group of other vehicles and had witnesses. I didn't even have to have one of them testify. Good luck.
Being a cop in Florida and also RADAR certified I can tell you how it is âsupposeâ to be done here.
1.See a vehicle traveling at a high rate of speed and visually estimate the speed.
2.Listen for the Doppler tone given off by the RADAR unit and again estimate the speed. Lets say 70 in a 45.
3.Look at RADAR to see reading, if my guess is within the âgiveâ 3 to 5 mph, if not then they go. If I am right and they are speeding within the range plus or minus, I pull them over for speeding.
That is how it is suppose to be done. I bet not always though.
Questions to ask officer.
What color was the car?
Is possible there could have been another car speeding not mine?
Are you RADAR certified in your state?
Was the RADAR tested before you went on patrol, was it tested after? What was the result.
When was the last time the RADAR was calibrated?
Can you go over the procedure for running RADAR?
Do you have your certificates for running RADAR and the certificate for the calibration? (A must in Florida)
Thanks for the good advice - and the sympathy! I put the car on a dyno about a week after it happened because I was also skeptical that a 14-year-old, 4-cylinder, 2.2-liter engine could make 122 mph. To my surpise, it made 136, although the tester said it likely couldn't sustain that speed too long without serious damage. Maybe he'll vouch for me.
Keep in mind that a dyno may or may not be set to factor in wind resistance and even though it would turn the tires that fast on the dyno, it still may not come anywhere close to that on the road.
John, my son has a four cylinder WRX that will do in excess of 150 mph. He's slighty " warmed " it up. He races it on track days, to do with the WRX club he's in and he is sensible when out on the road.

My truck shuts down at about near 100 mph, because of the tire speed rating, of course if you chip it you could change that. A four cylinder probably wouldn't make that speed.
