I was questioning the comment that being a member of a 'gang' (or assumed gang) in itself was a Felony Offense in CA.
From what mattyfatty says, it's not.
But it is an enhancement if you do commit a crime: that is, a robbery committed in the furtherance of gang interests will be judged more severely than an ordinary robbery.
But wearing gang colors isn't a crime "per se", even if undoubtedly it will put you in some trouble and attract attention on part of LEOs...

I'll say it again............"gangs" gimme a break...OFG I agree with you wholeheartedly.I seemsalotpeople on this forum refer to all MC clubs as "gangs".Kinda makes me laugh...the ones that refer to them as "gangs" seem to know much about the subject.........
yet they know very little.

I agree with you, unfortunately it's not so easy to tell "club colors" from "gang colors" when the gangs are the first to call themselves "clubs".
It's not a black and white world, there's a lot of grey, and lot of scumbags that take advantage of this to further their agendas...

So what's wrong with calling them gangs? If they are dealing drugs, committing serious assaults, witness intimidation, maybe the occasional murder in furtherance of the "club" then, I'm sorry, they're gang members. Thugs and criminals in a "club", committing crimes for the "club", are a gang as far as I'm concerned.

EXACTLY!!!

A "Club" is one thing... a "Gang" reflects criminal activity! The Cops popped a "Gang" of criminals... nothing more, nothing less! We should allbe pleased!

I bet a large percentage of people on this forum have been involved in some sort of criminal activity.Drugs,guns,assualt or whatever.Are they gang members too?Whenever you have a large orginization or club or group of people there will alwaysbe individuals who have broken the law or continue to do so but to make a generalization that they are all like that isn't fair.I'm not affiliated with any club but I will show my support and I've known several members over the years and everyone of themare hard working middle class people that never judged what others do or did.

I never had any trouble with "GANGS", It was always the "COPS" who gave me trouble. Oh well!

According to THE PATRIOT ACT which flew thru Congess aftr 9-11, just about any gathering of more than X amount of people for a "common purpose"are classified as a "gang", think about it, HOG, CMA, Patriot Guard and the 81's are all lumped together in the bucket called "gangs"..
