Is it considered Open Container if you have an already opened bottle of liquor in your saddle bag?

If the bag is accessible while you are riding then I would say it is.

Guess it would depend on the jurisdiction. Sort of like an RV or in trunk of a car. Is it easly accessable to the driver?? Good question..Maybe a LEO can answer for sure!

Well we are going into dry counties. In the evenings sitting around it would be nice to have a couple of drinks. It would be in the hard bag on my glide and I would have it locked.

An open container is an open container. If the seal on the lid is broken and a cop finds it, your done. Easy fix. Don't do anything to get pulled over and there is no reason to worry about anyone finding it.

Yes, technically it is considered an open container. (I've heard that corked wine bottles are an exception in some places).


If you get written up for it depends on the attitude of the LEO. The attitude of the LEO depends on your attitude.

I think in Texas the situation that you describe would be OK, I THINK! May depend on the LEO though. I do know that I followed a wine drinker all over the state one trip, and he didn't seem to worry about it at all!

Buy airplane size bottles (or pints if you drink more).

Only open what you will finish and don't carry left overs.

I think that when pulled over attitude and respect goes a long way as to how the situation ends up. Really, if it is open you are likely in a jam.

If it is in the saddlebag or tour pak and LOCKED, you don't give the LEO a hard time AND you HAVE NOT been drinking already, I don't believe there is going to be any hassle. Forget any of the above and you could have a problem. Done this many times, use some common sense, all will be well ........
