Sorry about your friend and I know the feeling. When I was hit head on by a drunk driver back in the 70's the guy got a DUI ticket, lawyered up got it reduced, delayed, delayed, delayed for over 1 year. Then got a 3 day DUI course and a small fine maybe $500. I was completely pissed in court but it was like I was not even there.

But my take on this is She killed someone. He is just as dead as if she shot him in the head. No BS I'm just a little girl I'm sorry I didn't see him Bullshit. Lots of hard time. 10 atleast with no parole. No drivers Lic ever. And she should proved the equal amount of $$ he earned toward his family for another 10 years. And that is an easy skate.
If she wasnt drunk, or doing anything else obviously stupid to create a case of criminal negligence....Sorry man for your loss and the family loss...It could have been that he was rear ended in a car in the same situation. Wouldnt change anything It wasnt intentional from what you have told us, and we have no info on this post about drunk,painting nails, eating, texting, using phone and IPOD all at the same time.....lets leave the cash settlement to his famiily and their attorneys. It wont bring him back , but it isnt like from what we know in this thread that it was on purpose or criminal. Just another case of I didnt see the motorcycle....or another lawsuit in the works, Wish I had a better answer than I am sorry to hear it.
If you accidentally read ended a guy in a car (easier to spot) and killed him and were sober, and all those trivial things that make a difference in determining fault and liability did not apply such as drunk, texting, drugs, so on so forth, would you think the same about it?
Does it make it justified? NO HELL NO. I am all for motorcycle awareness. Hell I am for driver awareness. I give every motorcyclist an area the size of a semi when I am in the cage, and am watching his back.
Again I do not know how some of these things happen but I think back to years ago before I gave a damn about me every being a motorcyclist...I am glad I was lucky enough to never hit one.
Again I am sorry for the family and the loss of your friend. I have been down the road and lost friends on bikes too.
I am sure she isnt happy about what happened....I dont know ONE woman who would ever get over killing an innocent man, on accident like that. I know if it was me and I was 18 and it happened to me....it would take a lot for me to get past it, and I would constantly be trying to help the victims family for years. I could never forgive myself.

Doesn't seem fair that the case could have been plea bargained,not like she gave up info or something.
Maybe her parents had some cash to hire a good lawyer?

What would be an appropriate punishment? How about at least 6 month hard time
Is there an appropiate punishment for that situation? Lets see, she took a life, if the guy would of killed her how long do you think he would be in for?
It would be very hard to be a Judge in that situation. Sometimes the judges hand is bound by the letter of the law such as a min. and a max sentence, he could of seen to it that the min was upheld.

Unfortunately in a lot of cases, these sort of cases boil down to someone knowing someone else in a position to change the outcome, favoritism or owing someone a favor. In the small town I live in, the local government is so ignorant and illiterate and so many related to each other, it almost like a different country. kind of reminds me of the movie, Deliverance. There a lot of "Scratch my back" mentality.
