Yes we own and use our cell/smart phone occassionally, but ALWAYS use them responsibly and we NEVER EVER text while in control of our vehicles. I'm 100% sure that your life is of less importance than mine.

As an example, in Illinois, there is no negligent vehicular homicide. The choices are only reckless vehicular homicide or a traffic violation. The differences between negligent or reckless are somewhat complicated (i.e., more than I have time to type at this moment). Reckless kind of boils down to doing something you *know* will likely cause someone injury or death.
An example of negligent vehicular homicide would be a driver making a legal u-turn, doesn't see an approaching biker. They crash, the biker dies. Doing the u-turn isn't a reckless act. It's situations like this where you see someone kill a biker & get off with a traffic ticket & a slap on the wrist.
Reckless vehicular homicide would be something like where a driver says something like "I was trying to decide if I should paint my nails or not. I thought it was probably a bad idea and dangerous, but then I decided to do it anyway." She makes a statements to the cops at the scene that she was painting her nails while driving, and there is physical evidence (nail polish all over the air bag and interior of the car). It pretty much takes all that in Illinois for the states attorney to charge someone with reckless vehicular homicide (after the dead biker's family calls him daily for 4.5 months).
As for civil suits - first, the person you are suing has to have some money. Then you have to go to trial and win. Then, you have to collect - and the court really doesn't help you on that part (see OJ Simpson civil suit).

It's called Inattentive driving. So lets waste our dam money by having law makers spend more time making new laws. Dam that makes me angry.
