Glad you are OK-I just posted my own thread (I'm ok, but) about getting rear ended. None of the suggestions about avoiding rear ended would have helped me, either. At a full stop waiting for the light to change,a car waiting behind me, and she decides to go--- BAM!! I was luckier than you, in that the car that hit me was going a lot slower than the guy that hit you. I am just starting the insurance process tomorrow. I KNOW it will be forever before I get my bike back. Sigh....
I am an honest guy and just wanted new handlebars and medical covered after a woman pulled out from a stop signin front of me. No hassle,I said.
My insurance adjuster called the woman's house and they refused to give their insurance company's name or policy number. She finally relented to give the insurance agency's name. Adjuster called the agency and the person from the agency said that since I did not hit the woman broadside, (dumping the bike in a lawn after deftly avoiding the car with locked up brakes, Thank God for dirt bike riding experience), the woman was not at fault and they were not going to even contact the woman's insurance company.
I was so pissed, that when the woman's insurance company finallycalled and wanted a taped Q&A session, I said to late, due to the action of the woman and her husband and Agency, I am suing for damages, pain and suffering, and being all around azzholes.
The woman admitted in the Police Report her guilt in the entire incident. Just didn't look left, she said.

PS, almost forgot, the Emergency Room did not take an MRI despite heavy swelling and pain in my right ankle. The X-Ray's were overexposed by tech's, so no muscle was visible. Surgeon I went to made me feel like a baby for complaining about the swelling and pain. I waited three month's for the Surgeon to decide to take an MRI, and SURPRISE!!! I hada ripped in half tendon in my right ankle!! Lost three month's of work all told. Dumb Beetch
glad you are ok. but trust me take your bike to your dealer.let them do the damage control.most insurance companys dont know crap about bikes. i went thru the same think about a little over a year ago.i did'nt think it was that bad ether.it cost me a new frame and a back fender and a few other things.but dont sign nothing untill you are happy with your bike .and your self.

I tend to filter through waiting traffic and plonk myself in front of the first vehicle to wait for the lights.
Dont know if that is legal over there though, hell I'm not sure if it is legal over here, but i have passed a police car once or twice and they never pulled me!
