I just read the 14th ammendment and (I'm no constitutional expert) it seems to say that no state shall deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws. The situation here is an employer restricting access to the property. The employer is the University of Chicago, which DOE has contracted to operate the laboratory on behalf of the U.S. Government. It isn't the state doing it, it is the University of Chicago with the blessing of Department of Energy management. DOE attorneys seem to be of the opinion that since this is a federal site, they can require helmets if they want regardless of the fact that Illinois doesn't require one. I'm not so sure they are right. If I am riding a motorcycle in compliance with all Illinois laws, how can an employer refuse me access to the worksite?

Considering your job works for or is a major part of the government that is probly why they are doing it. I dunno. I also work for the US GOV. Well, I am in the AF. Florida has a law that states you don't have to wear a helmet if you have extra insurance. For ANYONE entering and leaving Tyndall (I am sure the same for all bases) You must be wearing a helmet. A long with other things listed below. No Q's asked. Here, For a person in the military, I have to wear a helmet, bright colors, reflective gear, sturdy foot wear, long pants and a long sleeve shirt, and eye protection oh and gloves. Bright colors and relfective usually are waivered depending on time of day and who is at the gate. But this is the gear I have to wear on or off base no matter what. If somebody as simple as somebody out ranking me sees me off base W/o they could turn me in and i woud get it. For contractors who work on base, they are req'rd to follow the rules just to ride on base. I wish it was only the helmet but I live with it. If I get in a wreck w/o one req'rd item, the AF could say "no" to paying my med bills or paying my life insurance. Plus my beautiful girl would hate the idea of me w/o one-thats why i really wear one! lol
