Get yourself a lawyer, and you might be able to pay cash for a shiny new '08 (Thats my plan anyway).
Why give away 1/3 of your money when it might not be necessary. Wait until you hear what the insurance company is willing to offer you. If you think they are not being fair you can retain an attorney at that time (so long as it is within the statute of limitations). Keep in mind that with an attorney you will have to get 33 1/3 percent more money just to break even. Being a retired insurance claims manager my advice to you and to anyone that reads this is don't give away 1/3 of your money for no reason at all !!!!!!!!!!!!!

Wishing you a speedy recovery. Make sure you get a good lawyer and sue the hell out of the cager. That might keep him from totaling out some other bikers.
How did the cop know that you didn't get on the front brake hard enough?

He probably knew based on the speed before brake lock up versus the distance traveled with the brakes locked. I'm sure they measured the skid mark from the rear tire. Based on those two things you can predictthe distanceit should take to stop the bike if the brakes are applied properly.

Well Im glad your ok..I hope your not doen with bikes though....you gotta get back in the saddle!Ive been in your shoes and I couldnt wait for a new ride! It was abit nerving toget back in the saddle but 10 minutes later I was NORMAL agian! LOL GOOD LUCK ON THE HEALING.

Sure sorry that had happened, glad that its not been worse! Take your time, heal right. Don't let that bike worry you, plenty out there anytime you want you can get another one.

In time you may re-think your riding and want one. Not to hurry that either.

Damn cagers driving like they are wearing an a$$ hat being in a hurry all the damn time.

We need better laws against causing an accident like yours.I just hope that he does not get some crooked lawyer to defened his missirable but and get off scott free over all this!

You've got to get back on a bike as soon as you can.Even if you stop riding.It's not your fault this driver pulled out in front of you. It's still fun.

Damn man that really sucks......glad to see that you are able to tell us about it....hopefully you'll have a speedy recovery and evrything will heal as it should.......you can't let this get you down though......get better and get back on the horse and ride...I had a CLOSE a$$ call a few times and after the last one I thought that would be it...(3yrs ago now)....best decision I ever made was getting back on ......can't say I don't still think about it each time I throw my leg over.......but the way I look at it is this....if my time is up don't matter what I'm doing....it's up.....again take care hope you have a speedy recovery.

The fact that you can see some of the things you will do different in the future is a great thing. It's just a good thing you didn't get hurt any worse than you did.

I want to thank everyone for their kindcomments of support.This forum has a great group of members!The driver of the car was ticketed for the accident, beyond that I don'tknow much more. The details will come in the next few days. I don't even know what the condition of my bike is, but I think I will head over to where it was towed, and have friend strip the bike of all the salvagable extras that the insurance company probably won't cover.Ihave a$1000.00 deductable on the bike, ('07' FLSTC W/2000 miles) and the insurance won't come close to the $24,000.00 I have in the bike. But I don't really care at this point, I'm very lucky to come out of this crash with all my limbs still attached. In response to the question of how the police knew I didn't use enough front brake? The motorcycle cop probably saw the rear tire skid marks, and being familiar with bikes himself, knew that's probably what happened. Secondly,I have a whole new respect for the paramedics and police that responded to my accident. Also, the motorcycle cop who followed me to the hospital to check on my condition, went well above his job description. And finally, the kid driving the car made a serious mistake, but it was just that, a mistake. I don't need much more than to try and break even. I will keep you posted. Thanks again toall of you!
