I had a dude in a pickup sideswipe me the other night, he took out my left saddlebag, and the highway peg, along with scratching the paint on the side panel. He admitted to the trooper that he looked down for a second, the trooper cited him. I talked to the ins. guy the next day and he said they will try to get the money from the other guys ins. but I will probably have to pay the deductible, I need to find out what action I should take, I dont think I should have to pay anything, also, will they just give me the money and I get the stuff fixed or what. I have never dealt with this **** before, any advice would be great..
Hey, I work in Insurance and you have two options. First, use your collision coverage for your damages, pay your deductible and they will try and get your deductible back or you can try and go through the other carrier and have them pay 100% of the damages. You may have to submit an estimate as a lot of companies don't have Motorcycle appraisers. If your bike is still road worthy, be patient and try and get the check from the other company to avoid a paid claim on your insurance.
You will get the best service usually from your own carrier, but not always....Good luck and let us know how it goes. I assume you are okay which puts you way ahead of most of the bike claims I see, count your blessings!
Thanks for the info. Yea, I was real lucky, the truck grazed my leg but no injury. The thing that I am concerned with is #1 having to pay the deductible and #2 my ins. rate going up, hell I was stopped in traffic and on the right side of the lane, I was in no way at fault. Anyways thanks..
If you can wait, you don't have to pay anything.
If your in a hurry, You pay (or your insurance) and then go after his Ins. for the money.
But like previously stated, it'll show up on your Ins. unless you fight it.
get a attorney---------------this is a distracted driving deal that shouldnt of ever happened.Tell them it was so traumatic you cant get it up any more
I was hit in late October had a check for damages by first week in December. Paid 100% paid for my helmet and tow bill. Still waiting to settle for medical bills. This in Ohio.

I'd file a claim with his insurance first. Since he was cited it should be a no brainer. A guy knocked mine over in a parking lot, did $1500 in damage, and his insurance didn't argue. They even offered me a rental while mine was in the shop.
Local dealer submitted the estimate to the insurance and they paid them.
