Chances are it is the rear brake switch. It's hard to get to but you can pull one wire off if it and the brake lights will go out. About 20 bucks at HD for a replacement switch. You will need to pull the head pipe off to get to it then bleed the back brakes when you are done. May as well grab a set of exhaust gaskets and a fresh can of DOT 4 while you are at it.

Thanks this help greatly. I removed one of the wires to the rear break switch and the brake lights went out so I am guessing that it is the rear one that is broken. Also how can I tell if my Fatboy is a FLSTF or a FLSTFI?

The I stands for Injected. So, if you have fuel injection your FL is an I model. Some models dropped the I since that is all HD makes now.

If you are wondering if the "I" will make a difference in your rear brake switch it won't matter... they are the same part number.

There was a service bulletin on the rear brake light switch, not sure on the years though.
