Default NEEDING HELP-husband lost

Hi-I am new to forums so I hope I do this right. My husband didn't own a harley but he did own a 05 yamaha warrior. On Nov. 13 on his way to work, he was stopped at a red light. The guy behind him fell asleep at the wheel and hit him at 50 mph throwing him 130 ft. He didn't survive. The law in VA states that since he wasn't drunk or high he only gets a ticket for reckless driving. I am trying to fight this law and need all the riders I can get to help me out. I am trying to start a petition and hopefully find someone to design a website for me with an online petition. My dad is a member of the Harly Davidson Association and told me if I ever needed anything to get ahold of them. My husband was killed 3 days after his 29th birthday. I am only 25 and we have two kids-one is 5 and one will be 2 in Jan. I know he wasn't a harley rider but he rode all the same. I am begging for help!

I'm very sorry for your loss. Don't be concerned about what kind of bike he rode, we all know this could have been us just as easily. I live in Cal and don't know what I can do to help. There are some states that are passing laws to increase the penalty for this type of accident. You may find copies of their laws helpful.

I am so sorry to hear about your loss. That is devistating. I wouldn't be surprised though that they don't up that charge to reckless driving (care & control) causing death or manslaughter. These both are very serious offences and might include jail time. I don't believe that this guy would only get a wreckless driving charge. Even wreckless driving causing property damage holds a more serious penalty than simply wreckless driving. I would look into that more.

On top of him being charged with a very serious offence, I believe you can also sue him in civil court for wrongful death due to a traffic accident. Get yourself a lawyer...you need some professional advise!

Sorry for your loss, bikergirl40 hit the nail on the head. You need professional counsil. PM Dadofsix (his name on the forum), he's an ex-attorney in VA and probably can give you some good advice. I'm sure he will also state that you need to get an acting lawyer on this.

My condolences for you and your family, you're in our prayers.

I can't give you any legal advice and am not computer savvy enough to help with a web site. All I can do is say how sorry I am for you and your family and offer my prayers that you all pull through this difficult time. Don't matter if he rode a Harley, Yamaha, Honda or Sears Riverside we all face the same dangers from careless, unthinking drivers. I hope you can accomplish what you are setting out to do and remember we are all on your side. Again my deepest sympathy for your loss and if you need some friends to help you get through this, we're here if you want someone to talk to. Stay in touch.

YEAH!!! Just got off the phone with the dective on my case and he told me they are going to press more charges against the guy that hit my husband-most likely vehicular homicide or involuntary manslaughter!!!
