Ok. I see that. EPA azzholes. So this all relates to the tuner. So why is HD denying warranty if aftermarket slipons are used if no tuner was used and the cat is still intact. I was told it's the letter of the law by the dealer.
The dealer is misinformed. The tune is the only aspect that can void the warranty. That document I provided IS the letter of the law.

Election Madder. Few keep up. Look at why Jesse James in not in CA anymore. Lot of BS out there but he got nailed and fined for the bikes he was building not in compliance. The 1 off exclusions did not cover him. EPA has invade every part of our lives.
They also nailed DYNOJET some years back for there Tuners and forced changes to them along with big fine. EPA went after HD because they are a Big fish, the needed to slap a big one down and they did.
To me the sad thing is I/we see this thread every week since the release of the M8. How can someone spend $20,000+ and not do the least bit of reading or talking to your dealer about this stuff before purchase?
Ah, here we go again with the absolutely conflicting advice, guys offering 100% different advice.
Here's the facts on the ground:
1) yes your dealer is correct, Harley has done away with the dealer programming on the M8s.
2) The ONLY way to tune an M8, and retain the powertrain warranty, is to use the Screamin' Eagle Pro Street Tuner.
3) Harley is court-ordered by the federal courts to void any powertrain warranty immediately if they or their dealers have any knowledge whatsoever that an aftermarket tuner was used (specifically, a non-EPA-compliant tuner, which there are no aftermarket tuners that are EPA-compliant).
4) Yes aftermarket tuners are capable of more than the SE tuner is. Which is why they can tune your bike outside EPA guidelines, and why the federal courts required Harley to void your warranty if you use it.
5) Yes people have had their powertrain warranties voided for having used an FP3 or other tuner.
6) There are companies that CLAIM that they can restore the bike to undetectable condition. There is no proof that Harley cannot detect that an aftermarket tuner was used, and it would be the height of incompetence on their part if they couldn't, considering the feds are in their face about this whole issue. So you can gamble but if you lose, you lose your entire powertrain warranty. Is that worth it, for a couple of HP? Your call.

Item 1 seems to indicate that the dealership will not even use the SE Tuner, and item 2 would be false (as far as dealer participation goes). If Item 1 is not correct the list should be modified to make the situation more clear.

Eh. If your worried about the powertrain warranty you leave everything alone I guess until warranty is up. Then modify it and ruin the climate I suppose. Or you can just say *** it and do what you want.
