Not sure how you expect the police to be able to do this without a search warrant. From what I read in the post there is no probable cause to authorize one...unfortunately.
Hasn't happened to me on a bike in forty years ( well actually my buddy on his RKC rolled into me as we pulled of on the side of the road and bought me a new saddle bag lower, tour pak lower, rear fender and brace) but this year we have had three people hit our vehicles while using their phones. Guy in a new F150 slammed into our 2001 Expedition and totaled both trucks, one of my employees was injured and has not been back to work in almost 4 months. A few weeks later a lady in a VW Jetta ran into the rear of our VW Cc while we were sitting at a red light. Apologized that she was looking at her phone. $743 to repaint the bumper. Then a couple of weeks later on the expressway, bumper to bumper traffic someone rolled into the back of our Cargo van when my son stopped, using his cell phone. No damage to out truck but some real damage to his car.
Update: Estimates are $4600 and 8 weeks for painted parts. The TP lid and right bag lid survived. Won't be done in time for salt covered roads 2016. I'm told main frame, subframe, swing arm and rear wheel are straight. Guess I'm a sissy, felt worse than that. A few issues with neck, but it's not constant, no tingling or scary numbness. I work out pretty regular and I'm just getting back to it. I'll be adding LED lights to TP rack, bag lids and an LED tail light. New helmet will be bright, not black.
Filing through my insurance may not have saved any time, they had to be bothered by phone for 3 straight days after waiting 5 days before hearing NOTHING. Check just arrived, subjugation pending.
Glad to hear that things are working out for you. I was rear ended at a stop light about 13 years ago on a less than 6 month old black/silver 100th anniversary FXDWG.
The street I was on intersects with a more busy street, stop sign on my street and no stop sign on the intersecting street. I had come to a stop behind the car at the stop sign with one car behind me, as the car in front made a Rt hand turn I scanned left and right as I was slowly pulling to the line with my right blinker on. When I had scanned the intersection I saw a cop car coming from the right, so I made sure I came to a complete stop instead of rolling it to avoid a ticket. The car behind me "assumed" I was going to roll the stop sign and hit me in the back. Next thing I know I am standing in the intersection facing the cop car who came to a stop. Looked behind me a few feet and the WG was on its right side. I guess I was in a bit of a shock because all I really remembered was the feeling of being hit from behind, then standing in the street watching the cop get out and ask if I was OK. I said yes and he kind of chuckled and said I have never seen anything like that, when the car hit you it knocked the bike forward and you basically did a flip over the bars landing on your feet. Luckily there was no traffic coming from the left as I and the bike would have been thrown in front of them.
My first thought after telling the cop I was OK was the bike and I asked him to help me stand it up and get it out of the road. Cop ticketed the other driver who was very apologetic and just owned up to the fact that he made a mistake by assuming I would roll the sign and was not paying proper attention. This was 13 years ago and it was not likely the cell phone came into play. We exchanged info and I then accessed the damage. I could tell the rear rim was bent but still rideable, Handle bars were a bit bent, snaped off the end of my front brake lever, tail light broke, license plate holder bent, scratches on right side grip end as well as pipes and pegs. Amazingly enough not a scratch on any of the tins.
I was 5 miles or so from home and the bike fired right up so I rode home and took it to the dealership the next day. All total it was about $2600 in damages as everything that was scratched was replaced. The up side was that I had finally decided on a new set of V&H pipes to replace the stock pipes and was getting ready to place the order before the accident, due to pipes being scratched I got the V&H with no cost to me.
